NRPLBoardMeetingThe Board of Trustees of the New Rochelle Public Library issued a public statement today on their 7-month long investigation into Accounting Discrepancies first reported by Talk of the Sound last June.

After an investigation of the library’s financial records and those maintained by the City School District Treasurer, the New Rochelle Public Library Board of Trustees has determined that the apparent accounting discrepancy that was brought to the attention of the Board in June 2011 was due to an inconsistency in the designation and reporting of “restricted funds” versus “assigned funds” in the library’s Fund Balance. The cash shortfall was primarily solved by transferring funds owed by the Capital Fund to the General Fund in July 2011.

To prevent future accounting discrepancies the Board has taken the following measures:

Some Helpful Legal Links

January 26, 2012 - 02:38

As I continue to involve my law firm with the internet world, I have come across some very useful legal links to websites and blogs. Here are a few that I check regularly:

– Are you a U.S. Supreme Court junkie? Cornell Law School’s Legal Information Institute is a terrific resource. Check out this link to review the latest decisions from the highest court in the land:

http://www.law.cornell.edu/supct/

– There are so many other useful pages on this Cornell Law School site, but in particular, there is a link for New York law, which contains the NYS Constitution and statutes, Court of Appeals and Appellate Division decisions, and a lot more. Here is the link:

http://www.law.cornell.edu/states/ny.html

– Do you have questions about the NYS Civil Practice Law & Rules, better known as the CPLR? This blog has always been helpful to my litigation practice:

– I just added two RSS feeds to this Blog that you can find in the right column. The first is the Wall Street Journal Law Blog, and I always find it interesting:

– The second is FindLaw’s Noteworthy Decisions & Settlements Blog:

January 25, 2012 - 22:05

Mock trial jan 2012 copyNew Rochelle, NY (January 23, 2012) -- This past weekend, the Iona College Mock Trial Team secured an impressive second place in their first competition of 2012 - a 16-team tournament defeating teams from University of Minnesota, St. Johns University and Stonehill College. The competition took place at Fordham University's Rose Hill campus.

“This was our 6+ win of the 2011-12 season, after winning 6 ballots at UPenn in November en route to a 12th place finish out of 50+ teams,” said Coach Adam Detsky, Esq., who serves as a co-organizer of this tournament on behalf of Iona College.

Anastasia Nitis, ’14, a member of the honors program, was one of three students honored as a top advocate at the tournament. Anastasia is the second team member to receive individual honors this season. Steve Mayo Holds Press Conference at New Rochelle City Hall to Announce Legal Challenge to City Refuse Fee

MayoRefusePresserNew Rochelle Resident Steve Mayo has filed a court action called an Article 78. Article 78 is a mechanism of New York Civil Law that allows a regular citizen like Steve to stop a government agency or officer from acting outside their jurisdiction. That is precisely what the Mayor and Council are attempting to do by flouting the law that prevents them from using illegal revenue sources like the Garbage Fee/Tax.

Upon filing the Article 78 action, Mr. Mayo said, “I’m just one taxpayer and taking on city government is kind of a David Vs. Goliath proposition but I believe that when taxpayers see how outrageous this fake ‘fee-tax’ is, this issue will gain attention and support. Then we can work together as an informed and mobilized citizen group to stop this ‘slight of hand’ type of accounting in our city budget.

Mr Mayo added, “The presumptuousness, the disingenuousness of the majority in masking their machinations is positively insulting, never mind being a textbook example of 'opacity in government.'"

77 CentreAveHomeInvasion1

Moments ago, at approximately 10 am this morning, two men dressed in black clothing with black gloves and wearing black ski masks over their heads, kicked in the door to a residence at 77 Centre Avenue in Downtown New Rochelle this morning. At home was a woman with a small child.

The pair of intruders brandished handguns and forced the woman under a bed. The victim told police that the two men stole documents. A police dispatcher later said that money and jewelry was reported stolen. There was word on the child or injuries.

The two men, both described as male/black and speaking Spanish, fled the scene. Police were not sure if the men fled on foot or in a vehicle.

This is a breaking story. Police are currently searching the area for the two men. They are considered armed and dangerous. The New Rochelle K-9 Unit has been called to the scene. The NRPD Forensic Unit has been called to the scene.

The iOS 5.1 beta suggests Apple is on track for quad core

January 25, 2012 - 10:01

The giants of the mobile device market are racing in the direction of quad-core processor support. Reports indicate that Apple could have terminated a big shot. The iOS 5.1 beta has the earmarks of quad-core support, reports Engadget. Source of article: The iOS 5.1 beta suggests Apple is on track for quad core

Brand new reference for iOS 5.1

As reported by 9to5Mac, there are two images that suggest iOS 5.1 will support over just the same, old dual-core devices. The images relate to the processing core of whatever system runs the updated OS. As opposed to being named “/cores/core.1” as an OS optimized for dual-core processors would be, the iOS 5.1 beta references “/cores/core.3” as a marker for quad-core capability.

Presentation on Agenda 21, ICLEI and New Rochelle Mayor Noam Bramson's GreeNR Plan

I was asked to give a presentation on the above topic to the Reform Club tonight about 830 PM at the American Legion Post 8. I believe that this subject matter is little understood in New Rochelle and that GreeNR was passed by CIty Council without educating the public on the far-reaching implications of the City's decision to "partner" with ICLEI. I believe that properly understood, this partnership is the most significant change in New Rochelle since the City was incorporated in 1899.

I will make a slide presentation of about 20 minutes with handouts and then hold a Q&A for about 10 minutes after. I will then stick around for anyone who has additional questions.

Having put a good deal of time into the research for this presentation I am hoping to give it more than once. Towards that end, it is my hope that representatives from various neighborhood associations and civic groups might attend and evaluate the presentation with an eye towards inviting me to make the presentation to other organizations in New Rochelle.

Material for the presentation will be drawn, in part, from the following series in ICLEI:

All About ICLEI: Part I

All About ICLEI: Part II

All About ICLEI: Part III

All About ICLEI: Part IV

All About ICLEI: Part V

All About ICLEI: Part VI
