New Rochelle First Responders Have Hectic Friday Afternoon, 1 Arrested, 2 Dead, 3 Injured

Written By: Talk of the Sound News

New Rochelle police, firefighters and paramedics have had a busy Friday afternoon. In the span of one hour they responded to three serious incidents, two in the downtown area and one near City Park.

Around 3:30 p.m., a man in a green Toyota minivan with New York plates, driving near Main Street and Maple Avenue in downtown New Rochelle, struck multiple vehicles before coming to a stop in the middle of the road. One car was pushed up onto the sidewalk and into a street sign. The man was arrested for DWI. No injuries were reported.

Shortly after 4 p.m., New Rochelle police received a report of a person in a car parked in the library lot behind the new CVS on North Avenue. The man was found to be deceased and the Westchester County Medical Examiner was called to the scene to remove the body. It was the second time this summer that a dead body was found in a parked car in a downtown New Rochelle parking lot.

At 4:19 p.m., a call went out over the police scanner indicating a severe injury vehicle collision at 567 Fifth Avenue near City Park. A Toyota Camry and a Suzuki motorcycle resulted in a fatal injury to the motorcycle driver. Two of the three passengers in the car, a man and a woman, were seriously injured and taken from the scene on gurneys. A young boy in the car was not seriously injured and was able to walk to an ambulance. All three were taken to an area hospital.

The man on the motorcycle was pronounced dead at Sound Shore Medical Center a short time later.

UPDATE: The Journal News is reporting that the NRPD has identified the man on the motorcycle who died on Friday:

The cause of a fatal crash that killed a New Rochelle motorcyclist is being investigated by city investigators, police said Monday. The victim of the crash was identified as Paul Filippelli Jr., police Sgt. Myron Joseph said. No charges have been filed against Elaine Johnson, 51, of New Rochelle who was driving the 1999 Toyota involved in the crash with Filippelli’s 2007 Suzuki at 4:19 p.m. Friday on Fifth Avenue.

EDITOR’S NOTE: Kathy Steuber has created a Facebook Page called **BOYCOTT NR HATING ** Talk of the Sound. The stated purpose is to cause this web site to be shut down.

  1. One thing I cannot
One thing I cannot understand. These pictures are not on billboards or blasted all over the airwaves so that everyone must look at them. This is a website, people must log on to it, then flick through the photos. If it disturbs people, why are they logging in and looking at the photos?

Is this any different than the porn site run by the NRPD officers? Or for that matter, any different from the many disturbing websites that already exist in this country? I don’t get it.

  2. # of hits
The only thing Cox cares about is the number of hits on his site. So if we all just stop coming here to read or comment the ony ones that would be left would be Cox and his —— buddy Otoole.

  3. Hear it or not.
A lot of lessons in this accident photo controversy. Some ethical, moral, and some political, and now, here’s a practical one: I drive that route, 5th Avenue southbound, across the intersection at Potter Ave, and a right turn onto Pinebrook Rd, six days a week.

Just how fast can you be driving in the middle of a busy weekday afternoon on that road? Parked cars, shops, bus depots, lunch wagons, pedestrian traffic?

So what is it, Forty-five? Tops?

Here’s the deal; On a motorcycle, with a helmet, doing 40-45mph on a two lane road, in a collision with a vehicle, chances are very good, that you’re a dead man.

Those with ears to hear, hear it. Those not?

    Next.

    1. police investigation
There is an entire science in determining speed in a collision. According to the JN, the skid mark on the road was about 30 feet long which translates into a deceleration of 26-27 miles mph based on the vehicle coming to a complete stop. Based on the impact, the motorcycle was still moving at high speed at impact. The police are conducting an investigation but I would expect that they will determine that the vehicle was traveling well above 40 mph at impact.

On a motorcycle is is always a temptation to open up the throttle on a straight away; the problem is that you always have to account for other drivers doing stupid things — like turning directly in front of you at the last minute. I would like to think that this and other similar cases might convince people not to drive at high speed, especially on a two-land road in a high traffic area but we have all seen people on motorcycles weaving in and out of traffic at high speeds and I expect we will continue to see that no matter how many times there are tragic incidents like this.

  4. Karma….
I was told to read the comments posted on this page and reluctantly I did. I am just saddened that a large group from the community has asked you nicely to have the pictures removed. This is a community blog NOT THE NEW YORK TIMES. So I am not quite sure why after the friends and family members asked they be removed before the immediate family viewed them it was not granted. Paul left for work like he did everyday and on his way home was killed when his motorcycle slammed into a car that turned in front of him near city park. His bike was totaled. His body broken. Several people hurt. But most of all his family who was waiting for him to come home NEVER got to say goodbye. NEVER….AND NOW THE LAST IMAGE THEY HAVE OF HIM IS ONE LAYING ON THE GROUND WITH A GUARDIAN ANGEL WATCHING OVER HIS BADLY BROKEN BODY. YEAH WE ALL WATCH THE SAME RERUNS OF 9/11. It is still as sad as it was ten years ago however this is not a major news station or a major news paper. This is a community blog. The people of your community have asked you to take it down because it is to tragic and hit too close to home. What the hell does the other people you mentioned have to do with it. You are seriously trying to tie their names in with Paul’s death. Please everyone just let it go. It is what it is. This is not a person who can be reasoned with and I personally pray that one day his family will not be affected by such tragedy. REALLY FOR THE FAMILY JUST LET IT GO. If we were all smart we wouldn’t continue to be drawn to this train wreck. What type of person feels they have the right to display someones son on the internet in his hour of death. I am sick and disturbed. Just remember this when he tries to run again. He definitely does not have anyones back here. There was no need for any picture at all. NONE.

    1. Who speaks for who here?
“a large group from the community has asked you nicely to have the pictures removed. ”

      Asked nicely?

In fact, it has been a small group of people, mostly anonymous, who have repeatedly threatened and bullied with foul-mouthed rants, ad hominem attacks, insults, threats of lawsuits, boycotts, talk of coming to my house, dragging me into the street and beating me, harassing me, harassing anyone associated with my site, attempts to shut down my site, filing complaints with the government, my web hosting provider, calls to local media outlets, and the like.

I would say that is about as far opposite as asking “nicely” as you can get – and not the sort of conduct that would ever cause me to reconsider a decision to publish a story, photo or video.

Not a single person in this small group has once picked up the phone and asked to meet or discuss anything. On the other hand, I did pick up the phone and call Kathy Steuber, the leader of this campaign, and left her a voice mail which she did not return. How Ms. Steuber came to represent the Filipelli family in this matter is not clear but I have never heard directly from Paul Filipelli’s family or her or anyone else in this group.

The idea that the people involved are acting reasonably or approached me in good-faith is clearly contradicted by many of the recent comments on this site, the hate-filled, foul-mouthed and violent Facebook page and Ms. Steuber refusal to return my call to discuss her concerns. Many people are being told a complete lie — that Talk of the Sound refused a request from the family regarding the images and so a campaign was launched against the site to force me to remove images. They have been told other lies about the photos themselves. The attacks began almost immediately and no contact was ever made — the opposite of what this group claims.

There is a certain irony in Ms. Steuber’s role in all this. She and the Miceli family had no trouble reaching out to me when they wanted to promote Wings of Hope, the Shoppers Tote or their Jingle Bells & Whistles One Stop Holiday Shop & Tote event at Don Coqui last December — all of which I did. I never refused ANY request they made and happily promoted their event, their foundation and their product which is sold to raise money for her foundation.

      Suddenly, she lost my number?

On her Facebook group she had the following exchange:

Patti Pavone Mcdonald has anyone asked him to take them off?
Kathy Steuber yes. I asked nicely…..twice.

This is a complete and utter lie. Kathy Steuber NEVER asked me anything. She never called me, texted me, emailed me. I would like her to produce an email or a phone record showing that she has emailed me, texted me or called me in the past two weeks. It’s no wonder people are upset at me if they are going to be told lies like this by Ms. Steuber. Beyond that, even if she had contacted me, who exactly is she speaking for here? Regardless, she never called, never emailed, never sent a text message and when I called her she refused to return my call. I have a record of my phone call to her; does she have any records to support her claims here. No.

When I add all this up what I see is a small group of people, some with an agenda that has nothing to do with the tragic accident last weekend, attempting to fulfill a long-standing ambition to turn off the bright light that Talk of the Sound has focused on misconduct, criminality and corruption in New Rochelle. That is not going to happen. This is a light which has shone on the family and friends of quite a few of the people who have been active in stirring this issue including some involved in the Wings of Hope Foundation.

The idea that Talk of the Sound was “asked nicely” about any of this is not only laughable but demonstrably false.

      1. Mr. Cox I do not know Kathy
Mr. Cox I do not know Kathy Steuber and have no desire to join in in any part of the nonsense that is going on. The family didn’t approach you because they can barely get themselves through the day let alone deal with any of the things that are going on. I will tell you they were devastated to know that the picture of Paul was on this website before all the family members even knew of his demise. It is just the point of it. Don’t you understand? I am not part of any posse and do not have anything against you personally. I am asking you if you could please for the family have some respect and remove the picture. I will tell you the one good thing that did come from the photo was that they got to meet the young man leaning over him. He stayed with Paul until help arrived. So thank you for that, but honestly it is hurting the family. They are too devastated to deal with any of this let alone come sit and talk with you. Can you please just find it in your heart to respect them. I don’t know how all these people got involved and how this turned into the finger pointing and name calling. Paulie had nothing to do with any of this.Taking down the picture just shows that you do have a heart. There is a mother who lost so much SO can we just let it rest now. I am asking …..PLEASE.

      2. IF YOU GIVE ME YOUR EMAIL I
IF YOU GIVE ME YOUR EMAIL I WILL WRITE YOU NICELY. I am not sure what else to do but like I said this has nothing to do with any of the drama that is unfolding here. I would call you but where? Email/////Anything but I am begging now please don’t drag the family into this mess. It has nothing to do with them.

      3. That what i got from the picture
That’s what i got from the picture, I can see a bit of closure for the family knowing that someone was there for him. A lot of people don’t get to see what was going on in last moment of there loved one life, they could only guess and wonder. He was with someone… not like the pictures show over and over of the guy jumping from the trade center who is all alone in finale moment.

I thank you for pointing it out that something has good has come from the picture and if now a few more would look past the shock of it they too would see a bit of closure.

      4. cox
It dosn.t feel good when someone writes a lie about you for everyone to see, does it? Your a real piece of shit for letting this go on for so long, it’s a inappropiate picture that the family of the victum is requesting to take down, just take it down or maybe when someone does come and drag you out of your house and beat the living shit out of you we can start a “blog” and put the pictures of your fat ass suffering in front of 34 aberfoyle rd….I told you once and I’ll tell you again, eventually all your bulls*** and lies will catch up with you and hopefully I’ll be around to watch it all happen…Your a coward that hides behind a camera and web site, but remember that you have a wife and children too and you wouldn’t like someone disrespecting and defaming their names on a public blog…

      5. going alil too far
I’ve read everyone’s comments and I must say this is turning into a soap opera, nothing but drama.. I’m disappointed at some of these members on here, you say this is a blog site where people can come and freely blog their opinion, yet when someone does that and if it doesn’t sit right with another Blogger you resort to name calling?!?! Everyone has an opinion and its not meant for everyone to like or sit well with but that shouldn’t lead to someone being degraded and made fun of.. my opinion .. grow up learn how to debate your disagreement without insults.. Mr Cox I’ve listened to your radio show and I have an understanding now in the purpose for that photo my advice to you is if something like this should happen again in the future you should really emphasize the purpose of such photos so you can avoid personal attacks and perhaps try to contact a family member that said person might be in.. Dragonfly I would like to condone you on the way you came on here and handled the situation , its nice to see someone representing the family members in a respectable way , I don’t know all the family members but a handful that I do know are nice people, not people who will go to someone’s house drag them out and beat them all over the street, maybe when they were young ” teenagers” but they are all adults now with families or who are having families , my advice to those representing the family , represent them with dignity and respect, the last thing they need is talk of the sound/fb drama .. I must admit if this was to happen to me and my photo was on a community blog I wouldn’t want people making threats and what not all over the place I wouldn’t want to be represented like that or my family represented like that… Good job dragonfly!

  5. Mickey why dont you get off
Mickey why dont you get off Bob’s case and give it a rest. You dont come into NR and talk to a man like Robert Cox that way. Cox has his facts and knows the law.

    1. I’ve lived in New Rochelle my
I’ve lived in New Rochelle my whole life and I have a right to talk in anyway I choose. Mr. Cox is using the First Admentdment and so shall I…The Freedom and Speech. You will not tell me who I can or can’t speak to and what manner I can or can’t speak to them.

Mr. Cox this again is a personal attack on me and not a debate of the issue at hand or the article. I’m requesting you delete it.

  6. Mr Cox the BOED should
Mr Cox the BOED should consider bringing back Joe Johnstone, I know he was a bit rough but at least he wasn’t a sex pest like some of these other security gaurds they have now. Instead of John Quinn wasting tax payers dollars on all this sensitivity training he should save some of those dollars and fire Donna Henry, Marty Frieman and Tony Newman all in one shot, throw out the trash. Joe Johnstone had Donna in check because she sure in hell wasn’t bullying Joe around and he would have taken those weirdos Tony and Marty into the punishment room and taught them a lesson.

  7. Boycott Talk of the Sound
Bob, you are a horrible, heartless, narcissistic, untalented person who claims to be a reporter when it is convenient and claims to be a blogger when you need to hide behind the laws that protect bogger’s rights. The sad thing is that I like reading your site sometimes because you do expose the wrongdoing of officials and other things that are wrong in this city that others are not reporting, but in this case as well as in others you have remained pigheaded and stubborn, refusing to admit that maybe this is wrong and refusing to succumb to residents who are so hurt by the images you are defending. I have seen quite a few cases where you crossed the line and for that reason I would never vote you into any office in New Rochelle and would never promote your site in any way. In fact I have taken steps to have your site removed altogether. I appreciate your goal of exposing corruption in New Rochelle, I do not however understand why you do these things to hurt the very citizens you claim to defend. In short I really don’t understand what you are trying to do. You wouldn’t want to see images of your son laying dead in the street with his blood on the sidewalk. Your son is the very reason why you started this site. Be human Bob. Be a man. Take those pictures down, start being a reporter with integrity and maybe next time you will be voted into the positions of authority you so covet. If you will not even consider the feelings of the citizens you hope to secure as voters, how can you hope to have any voters? As long as you continue to vilify innocent people, who are family members or friends of wrongdoers by chance, you will continue to vilify yourself. You are cutting off your nose to spite your ugly face Bob. Enough is enough.

  8. Well I’m sure that now that
Well I’m sure that now that the investigation is over and no charges are being filed the names are released. But the fact that you posted pictures could have jeopardized the investigation. Also it still doesn’t defeat the fact that you violated the rights of the victim being extricated from the vehicle. My advise take down the pictures before you get fines or sued.

    1. Fines and Lawsuits and Physical Threats of Violence
      Mickey,

Thank you for leaving your real name. I am going to pass on your “advice” but let me give you some.

I have read through Kathy Steuber’s Facebook Page (linked above) and your comments here. I see you and others are proposing various theories as to how to use the courts to get a judge to compel the removal of images from Talk of the Sound — HIPPA, privacy violations, copyright law, etc. Here you are are again talking about fines and lawsuits. You may not want to take my word for it but you are barking up the wrong tree. For example, the Creative Commons License protects Talk of the Sound’s rights with regard to our images. It is not the basis upon which you can litigate to force the removal of images we own from our own site. There is no privacy issue for anyone out in public, there is no permission required for news photos, the only copyright issue is our rights to photos we took.

If you and some of the other folks on Kathy’s FB page want to expend energy on trying to figure out ways to use legal means — or intimations of physical threats of violence — to try to force the removal of images from Talk of the Sound that is your choice. However, I would suggest that you cut to the chase and consult an attorney. Your attorney will be able to explain that you have no case and complaints about HIPPA and Creative Commons and these other theories have no bearing whatsoever.

For those not members of Facebook and unable to read Steuber’s Facebook page, you will find among the members many people or friends and family of people who have been implicated in various ways by articles in Talk of the Sound including some members of the NRPD, DPW, BoE and others. Some of these folks are people connected to Jimmy Generoso and Domenic Procopio and the Beckwith Pointe Beach Club. You will see quite a few names familiar to Talk of the Sound readers like Bongo, Bonanno, Mirabile, Messina, Freiman, etc. I will leave it to readers to divine the motivations of some of these people in gathering online to discuss their various ideas on how to shut down this site.

To take but one of many examples, you will see Jennifer Freiman in there claiming that Talk of the Sound victimized her father. The only Freiman we have written about is Michael Freiman This is a BoE employee who was suspended for 30 days without pay following repeated incidents of overtly racist behavior — using strong racial epithets with children and staff at Jefferson Elementary School. Freiman had been given numerous warnings and was ultimately suspended and then transferred to yet another school. Talk of the Sound did not suspend Freiman we reported on the fact that he had been suspended and why he had been suspended. We explained that in the context of the Carino case which also involved Anthony Bongo. If Ms. Freiman has an issue with her father being suspended, if this, in fact, his daughter, she should take it up with the Board of Education.

There are many similar examples where members of this group’s friends or family have been involved in theft of services, theft of property, misappropriation, drunk driving and so forth. In some cases, the people have been suspended, fired, sued or arrested. Again, if these people have problems with our reporting on these things they should complain to the Westchester County DA, City of New Rochelle, New Rochelle Board of Ed and so on.

I was contacted yesterday by Westchester County Legislator James Maisano in his official capacity on behalf of the people in this group to remove images from Talk of the Sound. This was the first direct contact to me by anyone regarding these images. I am addressing this publicly because I believe I received an email instead of a phone call because it was blind copied to some members of the Steuber group. So, let me give all of them the same message I give Jim when I called him back. Any thought of having any discussion about removing any image ended when rather than contacting me directly to discuss any legitimate concerns of the family, members of this group chose instead to publicly engage in what is clearly an orchestrated campaign of threats and attempts at intimidation. Once that line is crossed, and it was crossed from the outset, there can be no question of Talk of the Sound acceding to threats of lawsuits or intimations of physical violence. Once a lawsuit is threatened it becomes a legal matter and from that point all communications should be made through attorneys. If members of the Stauber group wish to act upon their legal threats they should have their lawyer contact me at the information provided under “Contact” on this site.

      1. this is a joke!
Mr Cox I see your trying to cover up your lack of morals by telling your readers/ followers that many members of the fb group are affliated with new rochelle city workers who you have been ” exposed” by you and they are trying to get you shut down.. well Mr Cox I would like to share with your readers that, 1 I am a member of that group , 2 I don’t know everyone whose name you mentioned on there and 3 YES I am a family member ( a daughter to be exact) of a city worker you slandered on wvox BUT my involvement with that group has NOTHING TO DO WITH REVENGE or any of that sort .. it has to do with what’s MORALLY RIGHT.. Mr Cox your website is a community blog site, I thought you were for the people of New Rochelle, but clearly you have proven otherwise by ignoring request on your blog to remove some photos , your clearly for yourself and publicity. You have clearly shown your not part of our community, the photos you posted were of a man who was part of our community, he wasn’t from another state or anything of that sort, and Mr. Cox if that accident wasn’t tragic and you posted some pics maybe the responses you have been getting wouldn’t be so bad, but things didn’t end that way and everyone knows Paul’s condition in the pic you posted of him laying on the concrete, I hope you can see my point.. Again for all your readers/ followers my affliation with the fb group has nothing to do with revenge, I’m a new rochelle resident who is standing by other new rochelle residents in a time of tragedy and pain.. hope you will do the same Mr Cox

      2. OK But…
…You are confirming what I wrote, right? That some of the people who are in this group are part of the “friends and family” network in New Rochelle who wanted to see Talk of the Sound shut down long before this past week.

      3. Cox
I believe that even though some of the members from that FB group may be interlaced with other members of the community who have had issues with TOTS, they are merely involved by coincidence. Although those individuals may be fanning the flames for that grander agenda, they were not the catalyst behind the creation of the group.

Problem is simple. This little city often has a small town feel. Particularly when an individual involved in an issue is so widely known. Although I personally do not object to the content of the current clamoring, I can see how it might strike a nerve with some people.

Should you remove the pictures? I say no. If it was a faceless victim in Queens or Brooklyn, I doubt anybody here or on Steuber’s page would care.

Should you remove the pictures? I say yes. It would be a gesture that would be appreciated by a splinter sect of the larger community. It would also give them nothing more to say about you then “Thank You Mr. Cox.”

      4. Well you sure confused the
Well you sure confused the hell out of me with your last comment…you cant sit on both sides of the fence

      5. Point is simple
He doesn’t have to move the pictures, but at this point it should be a dead issue (no pun intended). Time and other news would have pushed this story away.

At this point Bob is merely capitalizing on the extra traffic that the angry mob has stirred up. Now would be the right time from a humanitarian perspective to make a grand gesture and remove the pictures.

      6. Pictures above
The pictures seen above are nothing but what we see everyday in the news. What’s the big deal? Why so much negative talking about it? I believe people who don’t like these kinds of images should refrain from watching the news on TV and going to websites that expose what’s going on anywhere in the world. Why not try a lighter approach to life by watching stuff like comedy, shopping networks, Martha Stewart, old series like Seinfeld and the like? Human beings love to create an issue where people are just trying to do their jobs. Nothing new here people!

      7. You are right Unner news ,
You are right Unner news , however this isn’t ordinary news. Don’t you get it? And ordinary new would not be so insensitve.

    2. OH BOY
Go back to your job at district control dispatch calls eat your grub and leave us alone. You never made it as a fireman always complaining and you were to fat.Get a LIFE

      1. Hey “hudson park” Who the
Hey “hudson park” Who the hell are you. obviously you’re not in the FD because you don’t even know the proper name of what dispatch is called. Number 2 I never worked there. And what does my being in the FD have to do with this. Why not tell me who you are and not be a coward, as Mr. Cox puts it, and tell me who you are.

All I can say is that if you think you know me. You don’t!!!! And like I said, you must not be on the FD which means….YOU DIDN’T MAKE IT!!! I did!!!

Oh and I do have a life. One that gives me the knowledge to be able to fight this.

Mr. Cox….you have this blog up about the article in hand….this obviously is an attack at me. I’m personally requesting that you take it down as it has nothing to do with the article or debate any of my comments.

      2. Why do you care?
Why do you care about his real name? Does that make his opinion more or less valuable to you?

This format allows people to state their true opinions without peer pressure or undo influence. People have a habit of taking things too far, which is why anonymity is so valuable in this situation.

Also, welcome to the world of blogging!

      3. I care because I gave my real
I care because I gave my real name as Mr. Cox asked me to. He said he didn’t reply to pseudonyms.

Now this person is attacking me hiding behind the same this that Mr. Cox finds cowardly.

Plus if someone is attacking me let them say it to my face not behind some screen.

      4. I do apologize I
I do apologize I misinterpreted what you wrote but you did say “As long time readers know, I have not the slightest interest in what a pseudonymous commenter has to say about anything. If you want to have your comments taken seriously by me then use your own name.”

      5. what I can’t figure out is
What the hell are you so concerned about some nondescript accident photos? Particularly these? What is the motivation here Micky?

      6. What happened to BOYCOTT??
I thought i read you and your friends were BOYCOTTING this site? Why are you still giving Cox and his wonder boy Otoole hits? I don’t think your friends on Facebook are going to like that.County Control!!!!!

  9. Ok this is getting to be ridiculous now
Enough is enough. These pictures are hardly inappropriate nor should they be considered offensive. Sure the victims family has every right to be upset here, but the body is not identified nor is it a picture that would expose his identity unless you were in the know.

Eyeonnewroc, while I agree that you have a “journalistic” license to publish these, you mode of response is shoddy at best, and well your real identity speaks somewhat to the nature of your response.

  10. Violation of Federal Law
I believe you are in violation of federal law by posing the pictures of the accident victim in the car. Now I will say I am a friend of the family of the person who tragically died in this accident, but the anonymity of the other victim in the accident must be upheld especially during any sort of investigation or in the case of the HIPPA act of 1997 by posting the picture of a person receiving medical treatment without the consent of the patient is PUBLICLY passing on the information of the patients condition and is in violation of the HIPPA act. So I will now implore you to remove the photos before I report the violations to the the Federal Dept of Health and Human Services. Also if you do not take down the other photos of the gore on the sidewalk I will have no choice but to contact the persons who own your domain and inform them of the lack of decorum for the respect of the victim’s families and that you are posting disturbing photos on your site. I’m sure a part of your Terms of Service agreement it has a morals clause associated with it. So before you turn around and refuse to take down the pictures think about this. You are currently looking at tens of thousands of dollars in fines as well as losing your website. I honestly would reconsider if I were you.

As far as my online handle I will say this. That is my nickname and was the only name I was known as. So you had better take this seriously. But since you will not take me seriously unless you know my real name I am signing this letter and if you need more information or to see the copy of the forms I have pre-filled out to send to the HHS just let me know.

    Mickey Melillo

    1. individually identifiable
individually identifiable health information from a picture…really, I now have to laugh my ass off!

      1. If you look at the picture
If you look at the picture and you know said person…guess what you just identified the person and hence have the picture in public view is considered a violation. So how about you identify yourself instead of being a coward and hiding behind a screen name

      2. identifiable health information
You can not get (identifiable health information) from a picture of someone. A neck brace doesn’t tell you that someone has hemorrhoids.

Violation of what?…. common I’m waiting! give the #/code that this fall under.

I rather be a coward than a Jackass that has no clue what their talking about.

      3. Oh Please
Every picture in every paper, website, ect is identifiable by somebody. I think you are stretching a bit too far here buddy. PLUS… if you really want this issue to go away, just ignore this. It will pass like all things do. The people crying here are only extending the misery of the family and attracting more attention to a site/blog that they find deplorable.

    2. Let me help you out
Please do not hesitate to file a complaint with the U.S. Department of Health & Human Services. To assist you I am providing a link to the HHS web site where you may file your complaint online:

      http://www.hhs.gov/ocr/privacy/hipaa/complaints/index.html

Please feel free to post their response here.

As for the people who own my domain, I own my domain. However, you may have meant you wish to contact the people who host my web site. In that case, to assist you there I am providing a link to the Terms of Service for my web hosting provider and contact information.

Again, please feel free to post their response here.

I suspect you will not because they are not going to give you the response you seem to expect.

  11. Little more respect
As a family member I have to agree the only good that came out of posting the picture that is most disturbing to all of us is being able to see the man that was with him in his last moments. I would also like to thank eyeonnewroc for sparing his family with the pictures you have that are worse then what was posted…I take that back, you have zero respect for the family! This is NOT news and the real reporters and major news stations have never shown pictures like this. This is nothing but a gossip site and as adults you would think you had something better to do with your time. I hope the other pictures you have haunt you in your sleep! As for Mr. Cox you should be ashamed for having someone like this writing for you! Also agree that I do not care what anyone has to say in response to this and will never come back to this site

    1. So sorry
I said before and i’ll say it again sorry for your loss. I will not take the pictures down all across this country worse pictures show up on the web and on news sites across this country. I had no idea who was in these pictures as far as i know it could have been people or persons from other states or country’s. What will you have said then? EXACTLY! It hurts that it is a New Rochelle resident and friend but it does not change the fact that if this site did not report it others would. I have worse pictures not taken by me or Mr.COX but by people who were there when the accident happened. Myself and Mr.Cox said to each other that we would not post those pictures.
Some people said the Journal News would not post pictures kinda funny the Journal News is Charging a price for there Photo’s.There are much more grafic photo’s out there of many accidents and i have them and so have most you. These photo’s are in no way are comparable to those. When and if someone or some people want to challenge that then bring it on. Just make sure you have a strong stomach because you have no idea what’s out there.

      1. The few “terms” of this site
The few “terms” of this site indicate that members respect one another and not be abusive , but what baffles me is YOU, and Mr.Cox don’t seem to follow the terms of your own website. You’ve had a few request from the family members asking you to remove the photos, which you refuse to do, if you ask me that’s emotional abuse , furthermore you and Mr. Cox have both stated you have more “graphic photos” of their family member, Mr Cox even gave an open invite to anyone who wanted to view them , again emotional abuse and disrespectful!! A family lost their loved one and a few of them pleaded with you to remove ONE horrifying photo, you nor Mr Cox can’t respect their one wish? Let this family grieve in peace they have been through enough the last thing they need to hear around town is their family members pics are posted on this site. With all due respect the both of you need to get off your power trip asap, and be respectable citizens!

      2. no requests
No one from the family has ever contacted me. The only direct contact I have had was from Jim Maisano and that came yesterday evening. I have addressed that in another comment.

  12. Pathetic.
To the person(s) who took these photos, and posted them. As a member of the victims family there are a few words I have 4 u…1…the only positive is that I am grateful for the man in one pic that stayed with my family member while others with no respect took pictures rather than make an attempt to HELP a man in need….but to have to see this …to have to see any pics like this is heartbreaking to family and friends.I get it ..freedom of speech..editorial consideration blah blah blah!!!But u disgust me.LOHUD had respect, they did not post any pics like this. Please leave the news reporting to the REAL reporters. Life is short and unpredictable, find something better to do with your time b4 ur time is up and all u are remembered for is being an asshole. I will not return to this site again, I am not interested in anyones response to this. That is all.

  13. Mr Cox, I am a member of the
Mr Cox, I am a member of the family, I also have worked with you in a local campaign last year. I am awhere you run a news worthy website, I believe the disturbing picture is the one of them working on our loved one. The helmet should represent how dangerous motorcycles are and the respect they should given when you on on one. Please in the future think about how difficult it is for us to look and not look at the last image of someone we love in that last moments. It would have better if it was not an option. A mother lost a son that day, a brother was lost, an uncle, a cousin, a friend, and a amazing man.

    1. I can certainly understand
I can certainly understand where you are coming from, it was not my intention to be disrespectful — as I said before, editorial consideration was given to which photos to use and not use out of just such considerations. I am certainly sorry for your loss and that of the family.

  14. I don’t see anything out of
I don’t see anything out of the ordinary with these photos and it always amazes me that people can make an issue out of a non-issue. My guess is that Bramson and company are out scanning this website and leaching on to everything they can to complain about so they can discredit and silence Bob Cox. It is the same way they most likely got WVOX to enact a new policy that limits free speech. I love the way things are done in NR–if you don’t like the message, shoot the messenger.

    1. Is there nothing that Bob
Is there nothing that Bob Cocks writes that you do not agree with? He is so one sided, does not check his facts, and seems to have a vandetta against the same people constantly. You should get a life, stand up for yourself and get off HIS coattails. It is disgusting that HE writes no-stop about the same people over and over.

  15. With all due respect –
It takes a wee bit of effort to click through the photostream to view all of the photos and no one who is inclined to feel the least bit queasy about these types of photos should make the effort to comb through the slides.

Furthermore, these are the exact type of photos that would be shown on the network news (a TV network would perhaps even use sweeping panoramic video footage). And, a single photo similar to anything shown above would run in any/all printed publications.

    1. true
I don’t know how many time I’ve seen the airplanes hit the towers and seen people falling to their death

This would be no different to these family’s and i bet you see and watch these over and over.

  16. I agree with ALL of you and
I agree with ALL of you and your comments and I do not think they should be putting up pictures like that but if you look at who wrote the story it was NOT Mr Cox it was a citizen of this GREAT city who has NOTHING better to do. The person who was killed in the accident was a good man and he should NOT be remembered by looking at his motorcyle or helmet and gloves.

    1. pictures
      Nunya,

I stand corrected, I misspoke. I believe the accident victim has a right to some degree of privacy.

    2. Well Nunya
These pictures in each of these stories run in papers and web sites all across this country and i can tell i have seen a lot worse.I had many more and many worse and choose not to post them.As far as your comment i have nothing better to do you can Kiss me where the sun don’t shine. What i do with my time is none of your damm business so go back to your own and kiss some more ass.

      1. run in papers and web sites
This web site is locally based and focuses on New Rochelle alone (New Rochelle Talk of the Sound)So the probability of friends and family of a local person seeing there loved one dead on a sidewalk is much greater than Fox News Abc NBC or any large network. So let’s not compare the content here to that of one of those networks. You can try to justify your posting the pics all you want but we all know it’s wrong. You obviously only care about being the first to “break the news” rather than thinking of the families of the deceased person.
Mr. Cox you should try to keep your staff under control or at least proof their photos prior to posting. After all it is your website and it only reflects unfavorably on you.

      2. not interested
I know you are a relatively new registered user but with all due respect, I have addressed this issue many times before. As long time readers know, I have not the slightest interest in what a pseudonymous commenter has to say about anything. If you want to have your comments taken seriously by me then use your own name. I have even less interest in being told how to run my web site. If you want to create your own web site you can make those sorts of decisions — I will even link to you if you do. If you want to write your own stories or post your own photos here I will help you do that. The one thing that is going to get the least positive reaction from me is someone telling someone else what they can or should write or photograph or video tape. It gets old.

I was at the scene, OK? I don’t need to be told how awful it was. The fact is that we had quite a few graphic photos. Likewise, I have had graphic photos of drowning victims, car collision victims, fire victims, people who have died in parking lots downtown and others. In this case, photos where the victim was clearly identifiable were not used.

As for national v. local covered, it has always been an editorial decision of Talk of the Sound to cover New Rochelle the way New York City or any large city is covered — the good, the bad and the ugly. Sometimes that means reporting on some very sad, very graphic events. That also means having to make some editorial judgments that may be objectionable to some. In this case, I took the photos and worked jointly with EyeonNewRoc to cover the three incidents.

I will take full responsibility for the photos that were included and those that were withheld. I will reject out of hand the suggestion that we selected inappropriate images or showed callous disregard for the victims. There were well over 100 photos; we picked a handful and gave consideration to each one that was published. You may wish to question the editorial decision making but to say that we simply picked photos for the hell of it is simply untrue. In fact, after we learned the operator of the motorcycle was pronounced dead at the hospital we expressly discussed not using any photos that could clearly identity the man until authorities had time to notify his family.

If you are really interested, we can meet and I can show you some of the photos that we elected not to publish over the past couple of years. It should be clear that we routinely withhold images for the very reasons you cite. In looking through the images again today I stand by what we published. I particularly disagree with the complaint about the image of the helmet and gloves. I was moved by that image and believe it is one of the best photos I have ever taken and one I believe other motorcycle drivers, including myself, would understand.

      3. on the contrary
Obviously the opinion of a “pseudonymous commenter” has peaked your interest due to the five paragraph reply given by you. If it bothers you so much then don’t allow pseudonyms.
So you only posted these photos out of all the graphic ones in your possession, because the victim wasn’t clearly identifiable? What other fatal accident occurred on 5th Ave yesteday? May we confuse them with another? I’m sure that makes the family feel so much better. My point is there is no need to post the photos of the severely injured or deceased. I’ll concede to the helmet and gloves photo, I was mistaken in my original post. It was the bloody sidewalk with the AED which in my opinion would be disturbing to the family.

      4. Just the fact that you are
Just the fact that you are showing blood and other images that could be construed as disturbing you should put up a disclaimer but know this is front and center on your page say HERE COME LOOK AT THE PICTURES WHERE A PERSON DIED.

You are a despicable human being that doesn’t care about anyone but yourself and as far as news the only news I’ve ever seen you post was news bashing my hometown or it’s politicians/employees. Is it really necessary to give a demeaning nickname to the former New Rochelle Police officer. The Journal News, New York Post or New York Times wouldn’t ever do that. If this was a paper I’d read the national enquirer before reading this piece of garbage.

Why don’t you become a real reporter and report the GOOD with the BAD with respect and dignity and not report news impulsively and “shooting from the hip”. Pretty much what I’m saying is stop talking out of your ass.

  17. Pictures
Mr Cox please try to refrain from taking pictures at serious incidents where the responders are too busy to establish crowd control as they are helping the injured. Crowd control is more than protecting the public from the hazards of the accident, Crowd control also protects the dignity and privacy of the injured.

  18. inappropriate photos?
Im curious Mr. Cox if while photographing the injured people close up, do you think about their families and friends who can possibly view the photos later on?
How about the motorcycle rider who subsequently dies from his injuries? Don’t you think maybe omitting at least those photos of him lying on the ground and the bloody scene with helmet and gloves would be appropriate? Or is your view that “it’s news” and all is fair? Can you explain your thought process to his family and friends? Im sure they might be curious as to the need to post them.

    1. totally agree
I was in horror that you even posted those pictures. Not cool. In your haste to break the news you did a disservice to your web site. Have a little respect for the family of the dead.
